The Essential Steps You Need To Take When Your Spouse Is Arrested For A DUI

If your spouse has been arrested for drunk driving and has asked you to help with bail bonds to get out of jail, then you need to take these steps to get the process started:

Step 1: Contact a Criminal Attorney Before You Call a Bondsman

Before you search for a bondsman to apply for a bail bond for your spouse, first you need to retain a criminal attorney with experience in DUI cases. Your spouse needs legal representation for their bail hearing and a lawyer can often get the bond amount lowered if they have enough time to review the case before it gets to court.

Step 2: Verify with Your Spouse that They do Not Have Any Outstanding Warrants

Before you contact a bondsman, you need to ensure that your spouse does not have any outstanding warrants or other legal problems you don't know about. If your spouse happens to have another warrant, then you could bond them out of jail only for them to be re-arrested and you lose your bond money.

When your spouse calls you from jail, have an honest conversation about their current and any past legal problems. As you talk, write down notes about all of the information your spouse shares with you so you can accurately relay it to a bondsman.

Step 3: Search for Bail Bondsmen in Your Local Area and Give Each a Call

As with any other for-profit service, bondsmen are independent small businesses and offer a variety of services for various fees. Some bail bonding companies only issue bonds for minor crimes while others will issue a bail bond for any crime. Once you have determined the bail bondsmen in your area who will issue a bond on a DUI case, then you should compare their fees with each other. All things being equal about the deal, you should go with the bondsman that offers the lowest price.

Step 4: Verify the Bondsman's License Number via the State Insurance Commissioner's Office

Finally, it is important to note that bail bondsmen are licensed by your state's insurance commissioner's office. Before you meet with a bondsman to pay for your spouses bond, first ask the bondsman for their license number. Look up your state's insurance commissioner's office's website online and search their database to ensure that the bondsman's company is in good standing. If they are not, then find a different bail bond company to work with.
